The Lawsuits
(as of May 5, 2006)

The Order issued by Judge Maddox on January 13, 2006 was all that we had hoped for and more. The bottom line is that, WE WERE RIGHT ALL ALONG!!!

The Judge ruled that the Washoe County Assessor did not assess our properties using the rules that had been approved by the Nevada Tax Commission; therefore, the Incline Village/Crystal Bay property assessment for the tax year of 2003-2004 was null and void.

He also ordered that the property assessment values be reduced to the year 2002, and that refunds of any monies that had been paid by the 2003-2004 Petitioners, in excess of the amounts paid in 2002, be refunded plus 6% interest.

On May 5, 2006 Judge Griffin also ruled that the property assessment values of 2004-2005 be reduced to the year 2002 and that refunds of any monies that had been paid by the 2004-2005 Petitioners, in excess of the amounts paid in 2002, be refunded plus 6% interest.

An 8% reduction in the Land Value taxation of properties in Incline Village and Crystal Bay, was granted by the Washoe County Board of Equalization in tax year 2005-2006. The Assessor appealed the County Board decision to the State Board which reinstated the 8% increase in land values. The League then appealed the State Board decision to the Court of Judge McGee, where it is currently pending.

Our most important case will be heard before the Nevada Supreme Court on June 15, 2006 in Carson City. The Washoe County Assessor appealed the courageous Order issued by Judge Maddox, on January 13, 2006. The Supreme Court will be making a determination as to whether or not to uphold the Decision of the District Court. THIS IS A MUST WIN FOR US!!!

Please, feel free to contact me if you have questions about our progress on the legal front; and, as always, my thanks to all of you for your terrific and continuing support.

Sincerely,
