Dear Fellow Taxpayers,

Every property owner in the Incline Village and Crystal Bay area has already received or soon will receive yet another Notice of Hearing from the Washoe County Clerk regarding the place and time of our “Class Action Petition” hearing before the Washoe County Board of Equalization.

As was the case with the last Notice of Hearings that you received, none of you must attend on February 23 nor do you have to submit any more data about your property. Attorney Suellen Fulstone will also be representing everyone at this hearing as well as the hearings that are scheduled for Feb. 16, 19 and 21, 2007.

The Village League to Save Incline Assets, Inc. ,Todd Lowe, Les Barta and I, (members of the Village League Board), filed this Class Action Petition on behalf of ALL of the 9000 property owners in the IV/CB area.

As many of you are aware, the Village League won for all 9000 of you at the 2006-2007 tax year’s hearing before the Washoe County Board of Equalization, a roll-back of the assessed value of your properties to the 2002-2003 tax year. This ruling was AFFIRMED by the Nevada Supreme Court

Additionally, you should have received a refund and 6% interest on your overpaid illegally collected taxes. Needless to say, the County has not been “gracious” in making those refund payments. Your taxes for 2006-2007 have been rolled-back but no monies have been forthcoming. Obviously, more court actions ARE BEING FILED, to force the county Treasurer to make those payments.

HOW CAN YOU HELP?

Our Attorney requested that we ask all of you who are in the area and can be present to attend our first hearing, scheduled for February 16, 2007. It is important for the “powers that be” to realize that they are violating the constitutional rights of thousands of IV/CB taxpayers by not issuing the refunds as ordered by the Nevada Supreme Court last December.

Additionally, the Assessor is continuing to use the appraisal methods that were ruled to be illegal by two District Courts and the Supreme Court to assess our properties.

If you have called the Assessor’s office to inquire about paying the fourth installment of your 2006-2007 property taxes, you were STRONGLY urged to make that payment. As the old saying goes, “Possession is 9/10ths of the law”, and THEY WANT YOUR MONEY!

    Reno, Nevada

The Complex is located at the intersection of E. 9th Street and Wells Ave. The Health building is in the back of the Complex and there is plenty of parking.
