NOW WHAT IS GOING ON?
ALERT: #119 Dear Fellow Taxpayers, Almost all of us have just received the Notice of Decision from the Washoe County Clerk regarding the roll-back of all of the assessed values of the Incline Village/Crystal Bay residential properties to the 2002-2003 tax year. However, like the ads for merchandise on TV always say, “There’s more!” In this case though the “more” is what the County neglected to tell you! The Washoe County Assessor has requested that the State Board of Equalization now hold a hearing to decide if the County Board’s Decision to roll-back the property values was correct! This is a year after the decision was made. Additionally, the State Board of Equalization, by law, is dissolved after October 1st of each fiscal year. Whether or not the State Board even has the authority to hear the 2006-2007 tax cases from last March is questionable. WHERE ARE THE REFUNDS? The Washoe County Treasurer has been told by the Washoe County Assessor not to pay any refunds or issue any credits etc. until after February 25, which is when we have found out that the State Board will hold its hearing. No one has officially been notified of this date. More than likely, the Department of Taxation will run true to form and give everyone the least amount of notice as is possible. Our attorneys have been hard at work to determine the best way to handle this situation. It is so frustrating, to say the least. Actually, infuriating would be closer to our true reaction to the duplicity and machinations of our “public servants”. WHAT HAS BEEN DONE SINCE THE SUPREME COURT DECISION? Motions have been filed in the Supreme Court for the Resolution of the Appeal, filed by the County, of the case heard by Judge Griffin that mirrored the courageous decision of Judge Maddox on which all of our success has been based. Additionally, Motions for the payment of costs and attorneys fees have also been filed. The Supreme Court released the document which finalized the terrific ruling that we received on December 28, 2006, just in time for a New Year’s celebration. Any fees and/or costs awarded by the court in that case must now be paid by the County. It takes so long to get results, but we are closing the noose a little more every day. We will keep you all informed as the process goes forward.
