Dear Fellow Taxpayers,

Our Supreme Court hearing is June 15, 2006 at 11:30 A.M. in Carson City. All seven Justices of the Supreme Court will be hearing oral arguments from the attorneys, and will be questioning our counsel as well as the opposition counsel regarding points about our tax case that have been made by both sides in voluminous documents filed with the Court.

FINALLY, this is the moment that we have been striving for four years to obtain. This is our opportunity to explain to the most powerful court in Nevada just how seriously flawed and unjust our tax system has become.

WE MUST STAND TOGETHER

This enormous effort was originally undertaken to benefit every property owner in Incline Village and Crystal Bay. If you own property here and pay property taxes to Washoe County, then you are a member of the Village League. We were determined to get fair property taxation for everyone in Incline Village and Crystal Bay and we are so close to achieving that goal.

Last February, we won before the Washoe County Board of Equalization the right to roll back the tax assessments for all 8700 parcels in our area to the year 2002. In less than two weeks, our battle for uniform and equal taxation will be in the hands of the seven Nevada Supreme Court Justices. We all have a huge stake in the outcome of this legal action. This decision will not only affect us now but into the future as well.

PEOPLE ARE WATCHING

Last Thursday, I spoke for forty-five minutes with a Wall Street Journal reporter who is following our Tax Revolt, and will be writing an article after our Supreme Court hearing. That reporter had been given our Email address by an Attorney in Florida who has also been following our progress. Many others have been logging on to our website, and are asking questions about how we got started and the “Tahoe Tea Party” that we held at Burnt Cedar beach. We HAVE come a long way!!!

Our Attorneys are working valiantly to put the final touches on their presentations. They are burning the midnight oil and spending an incredible number of hours perfecting our case. We all owe them a huge debt of gratitude, as well as a huge debt. I really hate to ask for more contributions, but we truly need some help. This is our last battle, and we have to WIN to keep what we have WON.

This will be the last Alert until after the June 15, 2006 Supreme Court hearing at 11:30 A.M. in Carson City. I would suggest that you arrive early, if possible. Remember there are construction delays on Hiway 28 and Mt. Rose.

Parking is available in the public garage on Stewart Street, just past Fifth Street and on Fifth Street between Stewart and Hiway 395. The entrance to the Supreme Court building is either from Hiway 395, through the park or from Stewart Street, between Fifth and Musser.

P.S. Many of you have called with concerns about the last Assessor’s form that you received. Yet another confusing and poorly written letter, (I think that they do this on purpose).

However, what you should be alert to is the veiled reference to the fact that even if you own homes in other states, and live there, the property that you own in Nevada is considered your PRIMARY NEVADA RESIDENCE, which qualifies for the 3% tax cap under the existing law.

If you don’t send in the signed form, or mistakenly mark your residence here as a “vacation” home, then you will be hit with the 8% tax cap.

On the first page, it obliquely references this, but on the back it just asks you to indicate your PRIMARY RESIDENCE. Fill in the Primary Residence balloon, sign, KEEP A COPY and send to the Assessor’s office. Hope this helps.
